Neighbors complain developer ignores proffers

Just
because a developer promised to comply with certain proffers – like avoiding construction on holidays – doesn’t mean the neighbors can trust that those
rules will be followed.
When
the Board of Supervisors approved Spectrum Development’s application
for a shopping center project on Leesburg Pike in Bailey’s Crossroads in January
2016, the company agreed that construction would not take place on holidays, including
the Muslim holiday of Eid-al-adha.

Yet
on Sept. 1, the day Eid was celebrated, construction went on as usual.
Neighbors also complained that construction vehicles have been routinely parked
on Washington Drive, which is also prohibited in the proffers.

We
were promised in the pre-construction meeting with the neighborhood that these
holidays would be taken seriously for our Muslim neighbors,” one resident wrote
in an email to Spectrum.

“This is a major mess-up,
and between this and the trucks going down the street illegally and the grass
being allowed to overgrow, it is very discouraging,” the email states. “What’s the
point of these proffers if they aren’t going to be followed? I hope the county
can start going by this site every day and be more involved, since it’s obvious
that Spectrum can’t self-police these things.”
Following the complaints to
Spectrum and to county officials, Spectrum Managing Partner Peter Batten
informed the community that construction would stop on Sept. 1 and that there
would be no construction on Labor Day.

Batten
also said the company will cut the grass and that the general contractor has
agreed to take action to prevent truck traffic on Washington Drive, advise all
subcontractors about the holiday schedule, and post construction signs in
Spanish. Drivers who continue to use Washington Drive will lose a day’s work.

    1. I thought the same about construction companies until I had my house built by NDI (New Dimensions) 3 years ago. They stuck to every promise, even when it became costly to do so. They didn't charge me a nickel over what we agreed to, and they finished on time. And NO, I do not work for them. Ha ha! I just want to give a rare, nice story to counter all the ugly ones.

  1. It's ridiculous that Spectrum is not sensitive to the neighbors religious beliefs after telling the County that they will be. Can the Blog follow up and see if the County is fining them or doing anything about this?

  2. Penny sold these developers as high end and detailed oriented. LOL. They either fooled her which doesn't seem hard to do or she was in on it and told them to promise what ever to get the neighbors to back down and don't worry about it as the County won't enforce anything anyway.

  3. Why do they get special conditions and proffers? When any of my neighbors do residential construction (permitted or unpermitted) their hired day laborers work all days, seemingly all hours starting in the early morning, and park wherever the hell they please. Who can I complain to?

  4. Who is more incompetent; Supervisor Gross for passing this joke or Spectrum for not being able to read a calendar. I mean seriously, this is construction 101 they are failing. Not a god look.
