Man charged with molesting child in daycare

Fairfax County Police have charged a 35-year-old man with having inappropriate contact with an 8-year-old child in the Bailey’s Crossroads area.
Police had been called to an apartment in the 3400 block of Glen Carlyn Drive at about 7:30 a.m. on Nov. 17 for a reported sex offense, the FCPD Police Blotter reports.
Officers met with the child and her mother, who had dropped off the child for daycare that morning before school. While inside the apartment, the child was approached by a man renting a room in the same apartment. He reportedly touched the child inappropriately and kissed her. She broke free, ran to the babysitter, and called her mother, who immediately returned to the apartment.
Police obtained arrest warrants for Santos Romero Gomez, 35, of Falls Church and charged him with assault and kissing a child under age 13 with lascivious intent. Gomez had rented a room in the apartment for several years where the leaseholder runs an in-home daycare business.
Police would like to hear from other parents who have had their children in daycare in that apartment and might have information about similar incidents. Is this a licensed day care operation? Where is the designated recreation area?
How can you have a day care center and rent rooms in the same 2 bedroom apartment?
Is this a legal, much less safe, situation for children?
I'm not sure of the details, but in-home providers can get licensing and insurance, though I seriously doubt that an apartment with miscellaneous others living in it would fit the requirements for safety, and I'm sure the landlord would want a big say in it, regardless. If the provider were at all licensed, this incident should put a lid on that coffin.
